It is an offence pursuant to 112 of the Crimes Act 1900 (NSW) to break into a house or a premises and steal property or commit any other serious indictable offence within that house or premises.
The maximum penalty for this offence is 14 years imprisonment.
If the offence is committed “in circumstances of aggravation” such as having a weapon or being in the company of another person the maximum penalty is 20 years.
If the offence is committed “in circumstances of aggravation” such as wounding or possessing a dangerous weapon the maximum penalty is 25 years.
In order to be found guilty of this offence, the prosecution must prove each of the following beyond a reasonable doubt:
- that you broke something;
- and by breaking something you gained access into a house or premises; and
- that you entered the house or premises; and
- you committed a serious indictable offence within the house or premises such as steal, wounding etc
